Terms & Conditions

The terms that apply when your business uses KwikShelfie.

Effective and last updated: 7 October 2026 · See also Privacy Policy

1. Acceptance of terms

These Terms & Conditions ("Terms") govern your use of the KwikShelfie website and app (the "Service"), operated by ARQON Group (ABN 21 803 532 642) ("we", "us"). By creating an account or using the Service you agree to these Terms on behalf of yourself and the business or organisation you represent ("Customer"). If you do not agree, do not use the Service.

2. Eligibility and registration

The Service is for business use. You must be at least 18 and authorised to act for the business or organisation you register. You must give accurate registration details and keep them up to date.

3. Business and venue accounts

The Service is used by hospitality, food-service and institutional kitchen operators, including restaurants, cafés, bars, pubs, hotels, clubs, caterers, bakeries, commercial kitchens, schools, childcare services and multi-site operators. Schools and childcare services may use it for their kitchen and inventory operations; it is not an education platform and is not intended for use by children. The account owner is responsible for the venue account and everyone given access to it.

4. Authorised users and staff access

Owners may invite staff and give them PINs. The Customer is responsible for deciding who has access, what role they have, removing access when it is no longer needed, and for all activity under its account.

5. Passwords and PINs

Keep passwords and PINs confidential and do not share them outside authorised staff. Tell us promptly at hello@kwikshelfie.com if you suspect unauthorised access. We are not responsible for loss caused by credentials being shared or not kept secure.

6. Permitted use

You may use the Service for managing your own business's stock, stocktakes, suppliers, orders, deliveries, waste, recipes and related operations, in line with these Terms and applicable law.

7. Subscription plans

Plans, included venues, users and usage limits (including fair-use limits on AI features) are described on our pricing page or in your agreed offer. We may set and adjust reasonable usage limits to protect the Service and control costs.

8. Trials and pilots

The current offer is a 30-day free pilot with Pro features and 150 AI credits for the entire pilot, as described on our pricing page. Day 30 is the final pilot day, followed by a three-day grace period (Days 31–33). Without a paid plan or agreed extension, access becomes view-only on Day 34; your saved data is preserved. Pilot dates use Melbourne time. We will tell you before any charges begin, and you will not be charged unless you choose to continue on a paid plan. Trial features and limits may differ from paid plans.

9. Fees, GST and billing

Fees are in Australian dollars and prices shown include GST. Paid plans are billed in advance on a monthly or annual basis using the payment method you provide. If a payment fails we may suspend paid features after giving notice. Owners and managers can change plans or cancel in the app; a cancelled plan stays active until the end of the paid period. Payments are processed securely by our payment provider.

10. Upgrades and downgrades

You may change plans where available. Upgrades take effect when processed; downgrades usually take effect from the next billing period. Downgrading may reduce limits or features available to your venue.

11. Cancellation and refunds

You may cancel your subscription at any time by contacting hello@kwikshelfie.com. Unless a statutory remedy applies, cancellation takes effect at the end of your current billing period.

Change-of-mind refunds are generally not provided once a paid subscription period has commenced.

Nothing in this refund policy excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. If the Service has a major failure, or another statutory remedy applies, you retain those rights, including any applicable right to cancel, receive a refund or seek compensation.

For billing or refund issues, contact hello@kwikshelfie.com.

12. Suspension and termination

We may suspend or terminate access if you materially breach these Terms, fail to pay fees, misuse the Service, or where required by law. Where reasonable, we will give notice and an opportunity to fix the issue first.

13. Customer data ownership and licence

You own the information you enter or upload ("Customer Data"). You grant us a non-exclusive licence to host, store, copy, process, transmit and display Customer Data only as needed to provide, secure, support and improve the Service, including sending it to our service providers as described in our Privacy Policy. You are responsible for having the right to provide Customer Data.

14. Uploaded images, documents and audio

You may upload photos, invoices, dockets, receipts, business cards, spreadsheets and voice recordings. Do not upload content you are not entitled to share, or content containing unnecessary personal information (including information about children). Uploads are checked for type and size before processing.

15. AI-generated and extracted information

Some features use an AI service provider to transcribe audio or read photos and documents. These outputs are suggestions only and may be incomplete or inaccurate.

Important: KwikShelfie assists businesses with inventory management and operational decision-making. AI/photo recognition, voice transcription, barcode information, invoice extraction, stock calculations, order suggestions, costings and other automated outputs may occasionally be inaccurate. You remain responsible for reviewing and confirming important inventory, purchasing, pricing, ordering, food-safety and business decisions before acting on them. KwikShelfie does not guarantee stock accuracy, supplier pricing, food-safety compliance or ordering accuracy.

16. POS and third-party integrations

Direct till connections are currently available only for supported systems shown in the app. Other systems may be discussed through a POS enquiry, which does not mean an integration exists or will be built. Connected systems are provided by third parties under their own terms; we are not responsible for their availability, accuracy or changes that affect the integration.

17. Third-party services

The Service relies on third-party providers such as cloud hosting, email delivery and AI services. Messages you open in your own SMS, WhatsApp or email apps are sent by those apps, only when you send them. Check every supplier message before sending.

18. Availability and service interruptions

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. Maintenance, provider outages, connectivity problems or device issues may affect access. Keep any records you need for business continuity.

19. Intellectual property

We own the Service, including its software, design, brand, logos and content (excluding Customer Data). You receive a limited, non-transferable right to use it during your subscription. Feedback you give may be used by us to improve the Service without obligation.

20. Prohibited use

  • Breaking the law, or infringing anyone's rights.
  • Accessing other venues' data or attempting to bypass security or usage limits.
  • Uploading malicious code or harmful, unlawful or offensive content.
  • Reverse engineering, copying or reselling the Service without permission.
  • Overloading the Service or using automated means to misuse AI features.

21. Confidentiality and security

Each party will keep the other's confidential information confidential. We use reasonable security measures as described in our Privacy Policy; you are responsible for securing your devices, credentials and staff access.

22. Data exports

Some information can be exported from the app (for example, spreadsheet templates and order messages). For a full copy of your venue data, email hello@kwikshelfie.com and we will provide it in a reasonable format within a reasonable time.

23. Account and data deletion

You may request deletion of your account or venue data by emailing hello@kwikshelfie.com. After cancellation or termination, we may delete Customer Data after a reasonable period, except where retention is required by law or in backups for a limited time. Request any export before deletion.

24. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will meet every requirement, or that outputs will be accurate, complete or suitable for food-safety, regulatory, financial or legal compliance.

25. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that cannot lawfully be excluded. If the Service has a major failure, or another statutory remedy applies, you retain all applicable rights and remedies, including any right to cancel, receive a refund or seek compensation.

26. Limitation of liability

Subject to the Australian Consumer Law section above and to the extent permitted by law: we are not liable for indirect or consequential loss, including lost profits, revenue, stock, spoilage, or business interruption; and our total liability arising from the Service in any 12-month period is limited to the fees you paid us in that period (or AUD $100 if you have paid nothing, such as during a free trial).

27. Indemnity

To the extent permitted by law, you indemnify us against third-party claims arising from your unlawful use of the Service, your breach of these Terms, or Customer Data you did not have the right to provide, except to the extent caused by our own negligence or breach.

28. Changes to the Service

We may add, change or remove features. If a change materially reduces the core Service on a paid plan, we will give reasonable notice and you may cancel.

29. Changes to these Terms

We may update these Terms. We will give reasonable notice of material changes. Continuing to use the Service after changes take effect means you accept them.

30. Governing law

These Terms are governed by the laws of Victoria, Australia, and each party submits to the non-exclusive jurisdiction of the courts of Victoria and courts that can hear appeals from them.
